Participant Waiver / Terms and Conditions

Clem Skates is a brand operated by Hill Bombers LLC.

Participant Waiver & Release of Liability Effective for all lessons, classes, events, and activities within Northwest Arkansas

1. AGREEMENT TO PARTICIPATE

By booking, attending, or participating in any Clem Skates activity, including but not limited to private skate lessons, group classes, Arkansas Skater Tots programs, Arkansas Roller Skate Crew events (program), outdoor sessions, or any related instruction, I acknowledge that I have read, understood, and voluntarily agree to the terms of this waiver.

2. ASSUMPTION OF RISK

I understand that roller skating and related physical activities involve inherent risks, including but not

limited to:

• Falls, collisions, and loss of balance • Sprains, fractures, concussions, or other injuries • Equipment failure or misuse • Uneven or unpredictable surfaces (sidewalks, courts, parks, trails) • Weather-related hazards (heat, rain, wind, debris) • Risks associated with outdoor and public locations

I voluntarily assume all risks, known or unknown, associated with participation in Clem Skates activities.

3. MEDICAL RESPONSIBILITY

I certify that I (or my child/ward) am physically capable of participating in skating activities. I assume full responsibility for any medical expenses, treatment, or care required as a result of participation.

4. EQUIPMENT ACKNOWLEDGMENT (VINTAGE / USED SKATES)

I understand that skates and equipment provided by Clem Skates may be vintage, used, or previously owned.

I acknowledge and agree that:

• Equipment condition may vary • I am responsible for inspecting equipment before use • I choose to participate with full understanding of equipment condition • I assume all risks related to equipment use

5. LOCATION ACKNOWLEDGMENT

I understand that all Clem Skates activities take place within Northwest Arkansas, including but not limited

to public parks, basketball courts, sidewalks, trails, indoor skating areas, and outdoor skating areas. I acknowledge that:

• Locations may vary based on lesson type, skill level, and safety conditions • Outdoor environments involve unpredictable risks • Surface conditions and surroundings are beyond the instructor’s control

6. THIRD-PARTY & LOCATION RELEASE

I hereby release and hold harmless Clem Skates, its owner(s), instructors, assistant teachers, volunteers, contractors, and affiliates from any liability related to participation.

This includes, but is not limited to, claims arising from:

• Public or private parks • City or municipal properties • Recreation areas • Any third-party location used for instruction

7. PHOTOGRAPHY AND VIDEOGRAPHY CONSENT

By booking or participating in Clem Skates lessons or Arkansas Skater Tots events, you acknowledge that photography and videography may take place during sessions.

Participants agree that media may be captured during instruction, including skating activity, movement, and group participation. This includes non-identifiable imagery such as the back of the head, skates, and action shots.

Consent for identifiable media use (such as clearly visible faces) must be selected at checkout or provided in writing prior to participation.

If full consent is not granted, Clem Skates will not intentionally publish identifiable images of the participant’s face, but may still capture and use non-identifiable content as described above.

Participation in lessons or events constitutes agreement to these media terms.

8. MINOR PARTICIPANTS (UNDER 18)

If the participant is under 18 years of age, I certify that I am the parent or legal guardian. I give full consent for participation and accept all risks on behalf of the minor.

I agree that this waiver applies fully to the minor participant.

9. INDEMNIFICATION

I agree to indemnify and hold harmless Clem Skates, including all instructors, assistant teachers, and volunteers, from any claims, liabilities, damages, or legal actions arising from participation.

10. VOLUNTARY PARTICIPATION

I understand that participation in all Clem Skates activities is voluntary. I acknowledge that I am choosing to participate despite the risks involved.

11. BEHAVIOR AND SAFETY POLICY

Clem Skates reserves the right to refuse service or discontinue participation in any lesson if a client engages in unsafe, disruptive, disrespectful, or inappropriate behavior that affects the safety or experience of others. This includes behavior that interferes with instruction, creates risk of injury, or disregards instructor guidance. In such cases, no refund may be issued for the remaining session.

12. ELECTRONIC CONSENT

By completing booking and checking the required agreement box, I acknowledge that this constitutes a legally binding electronic signature confirming acceptance of this waiver.

IMPORTANT NOTICE

This waiver is intended to communicate risks and responsibilities associated with skate instruction activities. It does not eliminate all risk of injury but serves as an acknowledgment of inherent risks and voluntary participation.

Clem Skates is a brand operated by Hill Bombers LLC. Arkansas Skater Tots and Arkansas Roller Skate Crew are program-based community activities within Clem Skates.
